Once we file your Chapter 7 petition, it functions as an automatic stay. This means that creditors must stop all collections activity and any communications will go through us instead.

Our Straightforward and Efficient Process

The Chapter 7 process might seem daunting, but take confidence in knowing that attorney Dana Milby will be your knowledgeable and understanding guide, every step of the way. Here is what to expect:

  • Fill out our initial consultation questionnaire and bring it with you to the first meeting.
  • During our initial meeting, we will gather basic information from you. We use this time to explain the Chapter 7 bankruptcy process and answer questions you may have.
  • You will leave with a bankruptcy questionnaire, which you complete at home. In addition, you will need to complete a pre-bankruptcy counseling course and provide us a copy of your certificate of completion before we can file your petition. Information on how to do this is also provided in the bankruptcy questionnaire document.
  • We review the long questionnaire during our second meeting and prepare your case and paperwork for filing.
  • During your third meeting, you review and sign the paperwork, and we file the case.
Interested clients may also choose our fast-track method, in which the long questionnaire in filled out in advance. We proceed with the last two meetings described above.

After we file your case, there will be a meeting of creditors before the Bankruptcy Trustee at the federal courthouse. The Trustee is in charge of overseeing and administering the case, and he or she determines whether there are any assets that can be liquidated to pay off debts. The process is informal and nothing to worry about — Dana Milby will be at your side throughout the process. About 60 to 90 days after the creditor's meeting, the Bankruptcy Court discharges your debt.
